Prohibited Activities

• forging, misrepresenting, omitting or deleting message headers, return mailing
information, or internet protocol addresses, to conceal or misidentify the origin of a
message;

• creating or sending Internet viruses, worms or Trojan horses, flood or mail bombs, or
engaging in denial of service attacks;

• hacking, and/or subverting, or assisting others in subverting, the security or integrity of
our products or systems;

• soliciting the performance of any illegal activity, even if the activity itself is not
performed;

• threatening bodily harm, or encouraging bodily harm or property destruction;

• harassing another, or encouraging harassing behavior;

• engaging in outright fraud, or using services to engage in scams like pyramid
schemes;

• collecting personal information about others without their knowledge or consent;

• instructing others in prohibited activities;

• using services to disseminate or display images classified under U.S. law as child
pornography, child erotica (regardless of literary or artistic merit) and/or bestiality;
and/or

• acting in any manner that might subject The Planet to unfavorable regulatory action,
subject us to any liability for any reason, or adversely affect The Planet’s public
image, reputation or goodwill, as determined by us in our sole and exclusive
discretion.

• creating fake weblog or weblogs which are intended or reasonably likely to promote
the author’s affiliated websites or to increase the search engine rankings of
associated sites.

• sending spam to weblog sites or automatically posting random comments or
promotions for commercial services to weblogs.


That policy is not enforced and the customer service department, legal department and abuse department of Theplanet.com are totally useless!

There is a slam site posted about me and my family. It shows the posts as being made by me and says that it is copyrighted by me. My identity has been stolen and my name, address, telephone number, stolen pictures of my children and a picture of my house are on this site Theplanet.com is hosting. Theplanet.com's customer that posted the site has already sued me and lost and all the court documents and pertinent information was sent in, but Theplanet.com is so poorly managed that these legitimate concerns are not being addressed. I moderate for Scam.com and we never allow personal information, images of minors, or harassment. If we can keep that site properly moderated and supervised why it is Theplanet.com is not able to do the same???

I have filed with the Better Business Bureau and will be pursuing this as far as necessary to get this resolved.

Have you filed a proper report with The Planet and give them time to sort it out? I know that they are sometimes a bit slow in dealing but they do look at everything. If you post a ticket number someone here will be able to take a look for you.

We monitor the security of a number of servers across the world, and The Planet has gotten better in terms of having less and less hacked servers (in the past, The Planet was our number one data center to report abuse; and now The Planet is on terms with Rackspace.com by number of hacked servers per week; yes, Rackspace.com has hacked servers -- and it typically takes Rackspace.com WEEKS to clean up hacked servers that have been reported where The Planet is usually, though not always, better in terms of faster clean ups).

Please do report any abuse to abuse@theplanet.com

Thank you all for your responses. ThePlanetAbuse-C44104347L is the ticket number? I have been shuffled from abuse to legal and gotten nowhere. One rep suggested contacting your customer who owns the site. They can't seem to grasp that customer sued me and the Better Business Bureau and lost and has a long career of threatening people. Contacting him will not get the site down. It will only escalate an already very dangerous situation. None of the reps handling this have contacted the attorneys that have handled these cases as I requested. My family is in desperate need of help here. I will private mail you the site, but I certainly don't want that slam site link up here.

I would appreciate any help to get that site down immediately.

Can you PM me the URL of the site you're talking about? I can't promise anything as far as resolutions go, but I'll talk to our abuse group to have them investigate.

Not quite on topic, but I'm a bit concerned about these two points that I had not looked at closely before:

What makes a blog "fake" -- or what makes http://blog.theplanet.com/ a "real" blog vs. one intended to promote the author's affiliated website (theplanet.com) ???

And does this

mean that if anyone has a web-related forum where someone posts a comment negative in any way to the planet that their servers will be terminated? Heck, if you post "sorry for the glitch in accessing our site - the planet experienced a network outage but it's resolved now" that could be determined to adversely affect the planet's public image. For example web hosting talk could never be hosted here with that provision (or at any provider having that clause since eventually everyone will have a glitch that will be discussed)

I suppose those are ok because I believe the planet and many other providers have a much more basic clause that says they can terminate service for any reason at will, but I wouldn't expect those two clauses to be enforced strictly as worded or there would be a real problem.

I can understand why LEGAL is involved. Identity theft. I am not defending whoever did this but want to point out that you cannot expect privacy in a public world. You step outside in view of the public and someone can snap a photo and you have no rights over it. Google has streetview and even though it blurrs address's, faces and license plate numbers, someone can still get a good view of the front of your house via that crazy looking car driving around.

My question is this, the site posted all this about you, and they sued YOU?

PM me about this because if they are posting your info, etc.... and are in the wrong.. how could they get a lawyer to take a case let alone a judge to sign off on them stealing your ID?

Score another one for the good guys. Twitter pulled down the account with my name on it today that was created by the same charming scammers as the ones behind the slam site one here. That little escapade didn't even last a full day. Victory!
