I know it is illegal to host any online gambling servers in the USA.

But is it legal for a website hosted at The Planet to show banner ads for an online gamling company located elsewhere in the world?

To answer your question, wilhelmae, if it is illegal in any form then its still illegal. Since you'd be advertising an act that would cross state and country lines, that would also make it illegal (against their Acceptable Use Policy)

However, hosting online servers that accept money, not necessarily gambling, isn't illegal in the United States (because if it is, then we have a HUGE problem) so I'd contact ThePlanet's Legal department and ask specificaly what you would be advertising for and let thier lawyers look at the fine print.

Now there are advertisements in my town for a casino in Michigan City, where gambling is legal. The difference between online gambling advertisements and that, is that you still have to travel to Michigan City for it to be legal whereas an internet based ad might mislead someone to believe it is legal to operate from their home internet connection.

I know a site right of that bat that adverts online gambling and is hosted in the usa, So it must be alright. Apparently nforcer has a degree in internet law though, so im sure he's the expert.

Matt2k also has a point, the law leaves online gambling/casinos/etc open to interpretation. If you're still looking for a legit answer, error on the safe side and don't put the banner up. However, if ThePlanet Legal Dept. doesn't have a problem with it, then make sure you have an email or some document stating such (should you be asked to remove it, or be taken to court).

If it were me, I'd have to be getting a lot of $$$ to have that banner for me to make it worth my time/trouble.
