in cpanel if you try and create custom error pages there is a little note:
'Custom Error pages smaller then 10k will not appear in Internet Explorer®'
does anyone have a work around for this? 10k for an html file is alot of code...

Just stick a image in it.

easily said... but adding an image tag to an html file does not increase the file size as much as you would think.

I will try again since cpanel has undergone quite a few revisions since my original post and will report the results.

how large is the custom html file? If its not larger then a certain amount (10k) it wont show up and will default to the windows one.

I don't know where you got 10k from... (if cpanel says it, its plain wrong.)
The smallest that will show up in MSIE is
512 bytes.

from cpanel:
Custom Error Pages
You can create customized error pages, so when a user types in the wrong url, or enters the incorrect information, so you can have nice looking error pages instead of plain old ones.
Note: Custom Error pages smaller then 10k will not appear in Internet Explorer®
I'm assuming this has more to do with the way cpanel works then IE
